The appellant, Joseph H. Kane (also known as Joseph Kelly), was convicted in a non-jury trial of operating a motor vehicle while his operators license was suspended. Act of April 29, 1959, P.L. 58 ? 624, as amended 75 P.S. ? 624. His sentence of two months to three years imprisonment was affirmed on appeal to the Superior Court. Appellants petition for allowance of appeal to this Court was then granted.
